The Insurance Commissioner of the State of California in his official capacity alleges that:
Respondent, ARA HENRY MKHITARIAN, now is and since September 16, 1999, has been licensed by the Insurance Commissioner to act as a resident Life Agent and Fire and Casualty Broker-Agent.
On October 22, 1996, in Case No. 6HL02704, in the Los Angeles County Municipal Court, Hollywood Judicial District, State of California, Respondent was convicted upon a plea of nolo contendere of disorderly conduct: lewd act, in violation of section 647(A) of the California Penal Code, a misdemeanor.

On February 11, 2003, in Case #3GL00231, in the Los Angeles County Municipal Court, Glendale Courthouse Judicial District, State of California, Respondent was convicted upon a plea of nolo contendere of battery on peace officer/emergency personnel, in violation of section 243(B) of the California Penal Code, a misdemeanor.

The facts alleged above in Paragraphs II and III show that it would be against the public interest to permit Respondent to continue transacting insurance in the State of California and constitute grounds for said Insurance Commissioner to suspend or revoke the licenses and licensing rights of Respondent pursuant to the provisions of Sections 1668(b) and 1738 of the California Insurance Code.
