WHEREAS, on March 7, 2008, JULIO CESAR BARRAZA, the Respondent herein, filed with the Insurance Commissioner of the State of California, an application for an unrestricted license to act as a bail agent. Said application is now pending and no permanent license has been issued thereon as of the date hereof; and,
WHEREAS, on June 9, 1993, in Case No. 93R09224, in the Municipal Court of Los Angeles County, Central Arraignment Courthouse Judicial District, State of California, Respondent, under the name of JULIO HERNANDEZ BARRAZA, was convicted, upon a plea of nolo contendere, of carry a loaded firearm in a public place, in violation of Section 12031(a) of the California Penal Code, a misdemeanor; and,
WHEREAS, on May 25, 1994, in Case No. 94M01995, in the Municipal Court of Los Angeles County, Alhambra Courthouse Judicial District, State of California, Respondent was convicted, upon a plea of guilty, of possess under 1 ounce of marijuana, in violation of Section 11357(b) of the California Health and Safety Code; a misdemeanor; and,
WHEREAS, on March 7, 1995, in Case No. 95M02423, in the Municipal Court of Los Angeles County, East Los Angeles Courthouse Judicial District, State of California, Respondent was convicted, upon a plea of nolo contendere, of receive/conceal stolen property, in violation of Section 496(a) of the California Penal Code; a misdemeanor; and,
WHEREAS, on July 17, 1998, in Case No. BA164195, in the Superior Court of Los Angeles County, Central District Courthouse Judicial District, State of California, Respondent was convicted, upon a plea of guilty, of possess controlled substance for sale, in violation of Section 11378 of the California Health and Safety Code; a felony; and,
WHEREAS, on July 25, 2005, in Case No. 5MT02140, in the Superior Court of Los Angeles County, Metropolitan Courthouse Judicial District, State of California, Respondent was convicted, upon a plea of nolo contendere, of driving under the influence of alcohol and/or drugs, in violation of Section 23152(a) of the California Vehicle Code; a misdemeanor; and,
WHEREAS, it is provided in subdivision (a) of Section 1669 of the Insurance Code of the State of California, in conjunction with Section 1821, that said Insurance Commissioner may, without hearing, deny an application for a license or a licensing right if the applicant has committed a felony as shown by a final judgment of conviction thereof;
NOW, THEREFORE, IT IS HEREBY ORDERED, pursuant to the authority of Sections 1669(a) and 1821 of said Insurance Code, that the application of Respondent, JULIO CESAR BARRAZA, for an unrestricted license to act as a bail agent be, and the same hereby is, DENIED.
IT IS FURTHER ORDERED that there be issued to Respondent, pursuant to Sections 1742 and 1821 of said Insurance Code, and upon full compliance with all statutory and regulatory requirements therefor, a restricted license to act as a bail agent, subject to the following conditions and restrictions:

Respondent shall obey the laws and regulations of the State of California, the United States of America, and every state and foreign government (and political subdivision thereof) having jurisdiction over Respondent.

IT IS FURTHER ORDERED, that the aforesaid restricted license to act as a bail agent shall remain subject to the conditions and restrictions hereinabove set forth until such time as said Insurance Commissioner shall, by written Order, remove or modify said conditions and restrictions.
This Order shall be effective immediately.
